Case:        Illegal Arrest and Detention

Case of illegal arrest raised before the SC

Andrea Rosal's arrested companion Edward Lazanas, who maintains his arrest is illegal, today filed a petition for certiorari at the Supreme Court.

Atty Cortez NUPL and Lazanas mother"The arrest of Edward Lanzanas is illegal and the charges against him are utterly false, just like the case of Andrea Rosal," Karapatan Secretary General Cristina Palabay said as Lanzanas' mother, Nimfa Dimalaluan Lanzanas filed the petition at the SC. Lazanas’ mother was assisted by the National Union of Peoples’ Lawyers (NUPL) through Atty. Rey Cortez.

Lanzanas is Rosal's companion when she was arrested on March 27, 2014 in Caloocan City. The two were nabbed by the agents of the National Bureau of Investigation using warrants  for murder and kidnapping with murder charges, both of which did not contain Lanzanas' name.

"The arresting officers made it appear that the alias 'Ka Jomel,' which is included as among the accused in Criminal Case Nos. 11-3248 to 11-3249, is the alleged pseudonym of EDWARD without any evidentiary basis at all," the petition said.

On April 14, Lanzanas, through his counsel, filed petition for writ of habeas corpus at the Court of Appeals but was immediately dismissed the following day. The motion for reconsideration was also dismissed on May 14.

"Lanzanas and Rosal are illegally detained for five months now at Special Intensive Care Area of Camp Bagong Diwa in Taguig City. Each day of their detention is continuing injustice to them and to their families. They should be immediately released," Palabay said.

Two relief workers and two other peasant leaders killed in August

“There is no let-up in the extrajudicial killings with BS Aquino’s Oplan Bayanihan. The killing of typhoon relief workers and peasant leaders further exposes the contempt of this regime against those who are genuinely working for poor communities,” said Cristina Palabay, secretary general of Karapatan.

Call for justice for the victims of human rights violation in Maguindanao province

Dear friends,

Please join us in our call for justice for the four-month old child victim of indiscriminate firing and the call to surface Mohammad Abdulkarim and his 14-year-old son Mehad Mohammad.

These cases continue to show that the military's presence in the communities endanger civilians, especially children.

Below is the account based on the initial report received by Karapatan:

Enforced Disappearance of father and son

Four-month old child hit by soldiers’ bullets, 14-year old boy abducted with father at a military checkpoint in Maguindanao

“BS Aquino’s Oplan Bayanihan spares no one. Through the program, the military kills, injures and abducts even children,” Cristina Palabay, Karapatan secretary general, said on the recent report of human rights violations received by Karapatan.

Based on initial reports, a four-month old baby was hit by soldiers’ bullets while a 14-year old boy was abducted with his father. Both father and son’s whereabouts are still unknown.

Generals Visaya and Año sowing Palparan-style terror in Mindanao

Gen. Palparan may be in jail, but his trained dogs, Brig. Gen. Ricardo Visaya and Gen. Eduardo Año are sowing terror in Mindanao," Cristina Palabay, secretary general of Karapatan said as human rights violations continue to rise in Mindanao.

Karapatan calls for release of arrested anti-pork activist, indigenous people’s leader in Surigao City

“Malacañang is a factory of trumped-up charges against activists and those who are demanding that BS Aquino be held accountable for the presidential pork aka DAP,” said Cristina Palabay, Karapatan secretary general when the human rights organization received reports yesterday on the arrest of an anti-pork activist and an indigenous people’s leader in Surigao City.

ML activists renew call "No to dictatorship! Never again to martial law!"--SELDA

"We ousted a dictator before. We can do it again!" This is how the martial law victims and their relatives expressed their resolve not to allow the resurrection of dark days of martial law.

Arrest of Palparan an indictment of the AFP hierarchy

Not contended with the exaggerated security measures, the call for transfer to military custody or additional deployment of military in the jail to secure him, a group in the military under the “Free Jovito Palparan Movement” now says they are ready to ‘take the bullet for Palparan’.

Palparan’s “I value my life” statement angers victims and kin

"This is a historic day for all victims of human rights violations," Karapatan Secretary General Cristina Palabay said yesterday as the group saw through that Ret. Maj. Jovito Palparan Jr. is brought to Bulacan Provincial Jail from the court hearing at the Malolos Regional Trial Court.

Palparan in trial

Victims, relatives and rights groups calls for vigilance vs. Palparan’s maneuvers

Even before the trial has started, the BS Aquino government and the AFP have expressed exaggerated concern for The Butcher Palparan—his safety and security, the so-called trial by publicity and on the day before Palparan faces the Court, the Malacañang statement that Palparan is “innocent until proven guilty.”

The butcher is a coward“The bias is obvious. We hope that these statements do not set the tone for the outcome of the case against Palparan, the possibility of a detention in a military camp, and whatever special privileges and concessions to delay delivery of justice to the victims and save The Butcher. Also, the government should have applied this ‘innocent until proven guilty’ dictum to those who were killed extrajudicially and to those who were jailed without warrants and on false charges,” said Cristina Palabay, secretary general of Karapatan.

No to special treatment and military detention for Palparan

“Butchers and cowardly generals like Jovito Palparan Jr. deserve justice –the kind that is commensurate to the number of civilian lives he and his men took and toyed with, while former President Arroyo and the military establishment were cheering him on. To play him up as the Armed Forces of the Philippines’ hero, to give him a minute longer to avoid prosecution, and then suggest to place him under military detention are all forms of travesty of justice. It encourages every person in uniform to do the same dirty deeds of Palparan,” Karapatan secretary general Cristina Palabay said in reaction to statements by former military officials and Sen. Antonio Trillanes over the week-end.

Make The Butcher Palparan pay dearly for all his capital crimes against the people

From the political prisoners at Camp Bagong Diwa

We, political prisoners, are glad that one of the most notorious fascist butchers of social activists and even of innocent masses has at last been caught and now held in jail—at least as of now.

PNP and AFP bagged 5.8M for arresting a different man, again

"Kumita na naman ang mga pulis at militar!" (The police and military just got richer!) Cristina Palabay, Karapatan secretary general said referring to the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) who allegedly profited from the recent arrest of 60-year old Eduardo Esteban. Last August 5, 2014 in Jaro, Iloilo, Eduardo Esteban was arrested under a warrant for Manuel Esteban, an alleged ranking leader of the New People's Army in Ilocos-Cordillera. Manuel Esteban with aliases Bonnie/Jun/Bennie has a P5.8 million bounty which has just been rewarded for the arrest of Eduardo.

Palparan's arrest does not end AFP's impunity for rights abuses

We in the Asia Pacific Coordinating Committee for Human Rights in the Philippines (APCCHRP), a campaign network of human rights advocates in the region, and the Hong Kong Campaign for the Advancement of Human Rights and Peace in the Philippines (HKCAHRPP), a Hong Kong – wide committee of human rights and peace advocates, welcome the arrest of former Gen. Jovito Palparan. Also known as “The Butcher” among human rights defenders, he had evaded arrest for many years after being charged with the abduction, torture and involuntary disappearance of student activists Karen Empeño and Sherlyn Cadapan in Central Luzon, Philippines.

BS Aquino hears his own murmurs, not the people’s voice

“Where does BS Aquino pluck his ideas? First, he says he is thinking of a second term through Cha-Cha (Charter Change). Second, he says there are no more ‘berdugos’ in the AFP. Which and whose voices does Aquino hear?” remarked Cristina Palabay, secretary general of Karapatan.

Palparan's arrogance, a coward’s mask—Desaparecidos

"Siya pa itong mayabang, pero sa totoo lang duwag siya! (He is arrogant, but in truth he is a coward!),” Aya Santos, Desaparesidos secretary general said referring to Ret. Maj. Gen. Jovito Palparan in reaction to the latter's “privilege” of holding a press conference yesterday at the National Bureau of Investigation.

Karapatan: Capture of Palparan does not end impunity

"Let's get this straight. The arrest of Ret. Maj. Gen. Jovito Palparan does not end impunity in the country," Karapatan secretary general Cristina Palabay said a day after the capture of Palparan. "The machinery of the Armed Forces of the Philippines (AFP) that perpetuates Palparan-style human rights violations against the Filipino people is very much active in implementing Oplan Bayanihan," Palabay said.

Arrest of two UP Clark students akin to Morong 43 health workers

"The manner by which the two UP Clark students were abducted—without any warrant of arrest, blindfolded and denied access to their relatives and lawyers—bear all the signs of an illegal arrest, " Cristina Palabay, secretary general of Karapatan said today on the cases of Guiller Cadano, 22, and Gerald Salonga, 24, last August 8, 2014.

Karapatan calls on victims of Palparan to come out and charge him in court

Karapatan welcomes the long overdue arrest of The Butcher Gen. Jovito Palparan Jr. Those who harbored and kept Palparan from arrest in the past years should be accountable as well.

Bayan, Karapatan and other orgs at the People's SONA file complaint to CHR, Ombudsman

"Those who exercised the right to express the people’s grievances to the Aquino administration were met with repression," Cristina Palabay, Karapatan secretary general said as the group, along with leaders of Bagong Alyansang Makabayan (BAYAN) and other progressive organizations, today filed complaints at the Commission on Human Rights against the Philippine National Police (PNP) for the garrison-style containment, use of water cannons and physical injury against the protesters during BS Aquino's 2014 State of the Nation Address (SONA) last week.
