Case of illegal arrest raised before the SC

Andrea Rosal's arrested companion Edward Lazanas, who maintains his arrest is illegal, today filed a petition for certiorari at the Supreme Court. 

Atty Cortez NUPL and Lazanas mother"The arrest of Edward Lanzanas is illegal and the charges against him are utterly false, just like the case of Andrea Rosal," Karapatan Secretary General Cristina Palabay said as Lanzanas' mother, Nimfa Dimalaluan Lanzanas filed the petition at the SC. Lazanas’ mother was assisted by the National Union of Peoples’ Lawyers (NUPL) through Atty. Rey Cortez.

Lanzanas is Rosal's companion when she was arrested on March 27, 2014 in Caloocan City. The two were nabbed by the agents of the National Bureau of Investigation using warrants  for murder and kidnapping with murder charges, both of which did not contain Lanzanas' name. 

"The arresting officers made it appear that the alias 'Ka Jomel,' which is included as among the accused in Criminal Case Nos. 11-3248 to 11-3249, is the alleged pseudonym of EDWARD without any evidentiary basis at all," the petition said. 

On April 14, Lanzanas, through his counsel, filed petition for writ of habeas corpus at the Court of Appeals but was immediately dismissed the following day. The motion for reconsideration was also dismissed on May 14.

"Lanzanas and Rosal are illegally detained for five months now at Special Intensive Care Area of Camp Bagong Diwa in Taguig City. Each day of their detention is continuing injustice to them and to their families. They should be immediately released," Palabay said.

“BS Aquino’s Oplan Bayanihan spares no one. Through the program, the military kills, injures and abducts even children,” Cristina Palabay, Karapatan secretary general, said on the recent report of human rights violations received by Karapatan.

Based on initial reports, a four-month old baby was hit by soldiers’ bullets while a 14-year old boy was abducted with his father. Both father and son’s whereabouts are still unknown.

To play him up as the Armed Forces of the Philippines’ hero, to give him a minute longer to avoid prosecution, and then suggest to place him under military detention are all forms of travesty of justice. It encourages every person in uniform to do the same dirty deeds of Palparan,” Karapatan secretary general Cristina Palabay said in reaction to statements by former military officials and Sen. Antonio Trillanes over the week-end.

PNP and AFP bagged 5.8M for arresting a different man, again

Last August 5, 2014 in Jaro, Iloilo, Eduardo Esteban was arrested under a warrant for Manuel Esteban, an alleged ranking leader of the New People's Army in Ilocos-Cordillera. Manuel Esteban with aliases Bonnie/Jun/Bennie has a P5.8 million bounty which has just been rewarded for the arrest of Eduardo. 
 

Palparan's arrest does not end AFP's impunity for rights abuses

Bayan, Karapatan and other orgs at the People's SONA file complaint to CHR, Ombudsman

"Those who exercised the right to express the people’s grievances to the Aquino administration were met with repression," Cristina Palabay, Karapatan secretary general said as the group, along with leaders of Bagong Alyansang Makabayan (BAYAN) and other progressive organizations, today filed complaints at the Commission on Human Rights against the Philippine National Police (PNP) for the garrison-style containment, use of water cannons and physical injury against the protesters during BS Aquino's 2014 State of the Nation Address (SONA) last week.
