Case of illegal arrest raised before the SC

certiorari at the Supreme Court. 

Atty Cortez NUPL and Lazanas mother"The arrest of Edward Lanzanas is illegal and the charges against him are utterly false, just like the case of Andrea Rosal," Karapatan Secretary General Cristina Palabay said as Lanzanas’ mother, Nimfa Dimalaluan Lanzanas filed the petition at the SC. Lazanas’ mother was assisted by the National Union of Peoples’ Lawyers (NUPL) through Atty. Rey Cortez.

Lanzanas is Rosal’s companion when she was arrested on March 27, 2014 in Caloocan City. The two were nabbed by the agents of the National Bureau of Investigation using warrants  for murder and kidnapping with murder charges, both of which did not contain Lanzanas’ name. 

"The arresting officers made it appear that the alias ‘Ka Jomel,’ which is included as among the accused in Criminal Case Nos. 11-3248 to 11-3249, is the alleged pseudonym of EDWARD without any evidentiary basis at all," the petition said. 

On April 14, Lanzanas, through his counsel, filed petition for writ of habeas corpus at the Court of Appeals but was immediately dismissed the following day. The motion for reconsideration was also dismissed on May 14.

"Lanzanas and Rosal are illegally detained for five months now at Special Intensive Care Area of Camp Bagong Diwa in Taguig City. Each day of their detention is continuing injustice to them and to their families. They should be immediately released," Palabay said.

"Too much injustice has been done to political prisoners like Rosal and Lanzanas. We call on the Supreme Court to heed to the prayer of the motion for certiorari and reverse the decisions of the Apellate Court," Palabay said. 

Andrea Rosal was seven months pregnant during the arrest. She endured prison conditions not fit for a pregnant woman. She gave birth on May 17 but the baby died two days after.

The group, with Karapatan-Southern Tagalog and friends and supporters of Rosal and Lanzanas, staged a protest action in front of the Supreme Court during the filing. They called for the immediate release of Rosal and Lazanas.
