Rosal’s family files contempt charges against BJMP lawyer, doctor and warden

Karapatan supports the move of the Rosal family in filing contempt charges against Jail Senior Inspector Dr. Jaime A. Claveria Jr., Jail Senior Inspector Atty. Crisyrel P. Awe, Jail Senior Inspector Ellen B. Barriosof the Bureau of Jail Management and Penology (BJMP).

“As a mother, Andrea Rosal suffered more than enough with the death of her child, as a political prisoner, she suffers the same fate as the others with her illegal arrest and detention and her condition in jail. And, for no reason. Yet, to the Aquino government this is not enough. The BJMP authorities forcibly transferred her to the jail from her hospital confinement without her doctor examining her for final discharge at the hospital,” said Marie Hilao-Enriquez, chairperson of Karapatan.

On June 4, BJMP authorities and guards forcibly brought back Andrea Rosal, a political prisoner anddaughter of communist leader Ka Roger Rosal, to Taguig City Jail at Camp Bagong Diwa from the Philippine General Hospital where she was confined. The Pasig City Regional Trial Court Branch 266 directed J/SInp. Barrios to return Andrea to the jail upon BJMP’s petition and based on the medical findings of Dr. Claveria. Andrea Rosal said Claveria had not checked her up since her confinement at the PGH. She only saw Claveria during the said forcible transfer to jail.

"Andrea’s transfer was done after office hours and without prior notice to Andrea, her attending physician and her counsels," said Hilao-Enriquez.

Rosal said Atty. Awe told her of her transfer at 5:30 p.m. of June 4. She insisted that her lawyers should be informed but "I was only given two minutes to prepare." BJMP authorities even prohibited her to use the comfort room to urinate before leaving.

"I was shoved to a wheelchair, which forced open my birth stitches. They transferred me against my will. All I can do is cry," Andrea stated.

Rosal is facing fabricated charges of murder and kidnapping with murder based merely on an affidavit executed by a ‘professional witness’ used by the military in the various trumped up charges filed against those considered ‘enemies of the state’.

"While the BS Aquino government insists on due process to investigate the financial records of Napoles and other plunderers, it has no qualms to arrest and detain its perceived critics on trumped up charges, minus the so-called due process. Such is the case of Andrea Rosal and other political prisoners," Enriquez said.

Andrea Rosal was arrested on her 7th month of pregnancy. She was put in jail conditions not fit for a pregnant mother which contributed to her child’s condition. Two days after her birth, her daughter, Diona Andrea died.

Karapatan called on the BS Aquino regime to release Andrea Rosal and all political prisoners.
